The Beatles, The Bible, The Bugliosi & The BS

THE BEATLES, THE BIBLE, THE BUGLIOSI & THE BS   

Put on by the children for a lark...

When the Beatles had finished basking in the counter-cultural glow of the (In)famous 1967 Summer of Love with Sgt. Pepper's Lonely Hearts Club Band, and the quickly becoming tiresome acid alliteration-Thank you Mike Love-of the Magical Mystery Tour, the brilliant lads from Liverpool got dark and serious with The Beatles AKA The White Album, released Nov. 22, 1968.

Charles Manson and his Family duly took note, and although Beatle George Harrison would later note that The White Album music "had absolutely nothing to do with...Californian shagnasties," and ""It was upsetting to be associated with anything as sleazy as Charles Manson," as Harrison said in the Beatles Anthology. Yet many of the songs contained on The Beatles would become LA assistant district attorney Vincet T. Bugliosi's prosecutorial template for the most bizarre and unlikely legally presented motive for mass murder in as Vince liked to opine, the annals of record crime.

Even the loud one (Ringo Starr) weighed in on the CM/HS wedding: "It stopped everyone in their tracks because all this violence came out in the midst of all this love and peace and psychedelia."

But, does the wedding of the Beatles, the Bible and the Bugliosi really amount to more than a whimsical wanking that was just a sign 'o' the times which will eventually be relegated to the dustbin of pop cultural and attendant legal history?

Let us begin by, as asked before on this Blog, do facts and those rendering them-even moi- really matter?

Some may opine that Vince Bugliosi's credibility on just about anything was severely whacked when in 2007 he produced a 1632 page tome on  the assassination of President John F. Kennedy, Reclaiming History, in which Bugliosi deduced, unequivocally, that Lee Harvey Oswald was the sole perpetrator of Kennedy's murder.

Reclaiming History could even be described in some way as fiction as here is the chance that Oswald was the lone perpetrator of JFK's death: ZERO!

And as one popular book on the JFK outrage's title announces, we will "not in our lifetime" know the truth. If ever.

But of course writing books became Vince's after Helter Skelter occupation and as well, you can't believe everything you read, it would be fair to ask if coming up with ridiculous and/or unbelievable scenarios and motives for a murder case were not the Buglioi MO. First HS, then "reclaiming history."

Bugliosi points out in Helter Skelter that a successful murder prosecution need not include a motive and in the case of the Manson murders, nothing could be more right on. Besides key physical evidence, eye-witness testimony from former and then current Family members, Vince T had an embarrassment of riches evidence wise but he also had what he very cleverly deduced was a great gimmick.

Despite the fact that Vince was not the kind of guy who rushed out to Tower to grab the latest Fabs' LP, he was culturally astute enough to dig the incredible allure of mixing the biggest rock band in the history of the world's music with drugs and beautiful people and sex and murder and well, the 60s.

He shook it all up in a Beatle blender and out spewed a sensational, sexy serial murder narrative that the mass media was and is orgasmic with, now approaching 50 years on.

Hangers on to the Family provided Vince with amazing tales of Helter and Skelter and Bugliosi helped those fantasist repeaters to weave a somewhat coherent if not accurate narrative for court-and most importantly-media proceedings. If you doubt this, listen to the hours of interview tapes of those concerned on YouTube.

Sure, the defendants ran their mouths in court about the black magic of Helter Skelter and yet they were just part of the circus of performing seals directed by Charlie and also a possible defense of the mens rea of the accused who were perhaps not as out-of-it nuts batshit crazy as was assumed.

And for those still in the joint for the crimes, it is still (eventually) legally helpful to claim a diminished capacity was to blame for their actions. (Although a listen or read of some of their parole hearings would seem to indicate that the parole board members are hip to this tactic as evidenced by government claims that the convicted Family members are still a "danger" to the community.)

Seriously, think about how the Manson saga would have played out without the inclusion of a Beatles angle to Charlie's koo-koo for coco-puffs philosophy and prophecies entwined with the Bible.

If it were just Charlie interpreting the Bible to his own devices sans Beatles, a big Elmer Gantry yawn would have emanated out of Southern California. Just another "born again" nut reeking havoc was how it would have been seen, and more importantly, covered.

The Beatles were the key to Bugliosi's post law career lottery win, but the lore of Helter Skelter was just nonsensical collateral to the conviction of Manson and 6 of his followers. He and the others were always going to be going down fast.

  1. Wait, why is Bugliosi the bad guy? The blame towards all of this should be on the idiot defendants themselves. They not only talked about Helter Skelter, but, if memory serves well, didn't one of the killers paint "Healter Skelter" in blood at the LaBianca crime scene? Bugliosi didn't just get that idea from hanger ons. The bizarre behavior of all of those weirdos helped convince the world that they were following the orders of a complete & utter madman over Helter Skelter. Bugliosi himself had even admitted that there was more than one motive. Why would he pick the hardest one to prove? He was a human being with faults like everyone else, and yes, he made a lot of money on the book, but what about all the people that have made money off other true crime books? What about Ann Rule, Kathryn Casey or even Truman Capote? Why does everyone hate Bugliosi so much? He was a hero, in my opinion. Bottom line, he won convictions on all the vermin responsible for the savagery!

  2. Agree, Ann. Wish I could have shaken that man's hand. I don't think Bug shook things up in the Beatles blender and spewed out nonsense. I think Manson shook things up in the Beatles blender.
    That said, I loved your post, Terry, and all the Beatles links (although I do believe Oswald worked alone).

  5. I must be so ingrained with establishment that I can’t see, hear, or read correctly. The volume of evidence collected by law enforcement by way of verbal statements from dozens involved with the case, all contained the HS narrative. A large number of statements were given to law enforcement prior to Bugliosi being assigned the case to prosecute.

    I don’t think most people realize how hard it is to get a group of 30 or more on the same page. It’s like the telephone game- The drug burn copycat narrative reminds me of this.

    My guess is that Bugliosi represents the establishment to some people- therefore, they can’t accept him or the way he prosecuted the case as factual, truthful, or accurate.

In the Respondent's brief in the Manson appeal, the prosecution devotes a full 20 pages cataloging the hundreds of instances where people testified to Manson discussing the Beatles and Helter Skelter. As Astro said, dozens of people both inside the Family and out. Moreover, just about all the words written in blood "Healter Skelter" "Pigs" "Rise" were direct references to Beatles songs on the White Album.

    I had a professor in law school, a former US Attorney now federal judge, who said that as a prosecutor they always provided a motive because it was human nature for jurors to try and explain things by supplying their own motive if you didn't give them one and that that was a big potential problem.

    Bugliosi's job was to get a conviction in a nine-month trial that ran the risk of going off the rails on what seemed like a daily basis. There are dozens if not hundreds of instances where some action by a witness, or a defendant, or the defense counsel that threatened to result in a mistrial or some other irreversible error. No, Helter Skelter and the Beatles may not have been the real motive, but it's the motive that Charlie served up on a platter with watercress around it.

  7. I do not know of the validity of the cult or Helter Skelter motive, but it was clearly not something that Bugliosi created. This is why I have not completely dismissed it in favour of the Free Bobby or Drug theories.

    Before they were arrested, Brooks gave a recorded statement where he details Manson's beliefs and Helter Skelter. That statement was made without knowledge of the murder's and as it was done before the arrest, without interference from Bugliosi.

    On the issue of motive, I place more credibility to pre-arrest evidence than testimony provided post arrest or post trial. So please someone destroy the Oct.3rd statement from Brooks.

    You raise one of the questions that has confused me since I started lurking on these sites: what exactly did Bugliosi do that was wrong? (If anyone chooses to answer, I don't need to hear about the milkman, the 'Hollywood Hit List' or his alleged affair(s)).

    As Peter notes, Manson spoke incessantly about HS to anyone who would listen including strangers. He also spoke incessantly about the Beatles and the hidden messages. He even mentions these 'messages' in his courtroom statement.

    “The music speaks to you every day, but you are too deaf, dumb, and blind to even listen to the music.”

    “It is not my conspiracy. It is not my music. I hear what it relates. It says, "Rise!" It says, "Kill!" Why blame it on me? I didn't write the music.”

    Assume HS was all bluff and bluster. Assume Manson believed none of it and it was all just a bunch of crap to impress a bunch of impressionable young girls and get laid.

    Assume what you want about HS. Even assume it isn't the motive. Perhaps, then someone could explain to me why it is morally or ethically wrong for Bugliosi to take the evidence Manson handed him on a silver platter and say to the jury ‘there is your motive’ and/or use that motive to convict a bunch of murderers?

    Although he argued three motives I can give you one pretty good reason why Bugliosi included HS having nothing to do with any book deal. I can even give you a good reason why he chose HS even if Bugliosi knew it was not the real motive for the crimes.

    That reason boils down to seven words which Bugliosi planned to present to the jury. Seven words he would use to try to convict Manson but they needed context: “Now is the time for Helter Skelter”. Without the HS motive these seven words are meaningless like saying ‘now is the time for dinner’. But with the motive they become ‘now is the time for us to commit murder’.

  9. Does Brooks mention Helter Skelter by name. I am sure that in his October 3d statement he never mentions any racial motive which is one of the most important aspects of Bugliosi's Helter Skelter, that it was intended to start a race war. I don't think the race element began to appear in Manson's statements until February or March of 1969. Brookes may already have been in the desert at that point so Brooks, although I agree with you and consider Brooks statement as being one if the most reliable, I don't think he was around toward the lead up to TLB.

  11. I personally don't believe HS was the underlying reason behind the TLB murders, but that is at this point impossible to prove. Bugliosi seized on it as a motive, and rightly or wrongly it's now the motive of record. As for Oswald, to state categorically that it was impossible for him to have committed the crime(s) alone is absurd...it does seem there are some parts to the story missing but it's certainly possible the whole thing went down just like the Warren Commission said it did.

  12. Unlike other lawsuits in more recent times, the blame wasn’t shifted to the band itself. Judas Priest, Ozzy Osbourne, and others have been sued by parents claiming their child committed suicide because the Music told them to do it.

    That said, I wonder why Tipper Gore didn’t have the Beatles added to the list of “explicit” artists back when she and the PMRC were in full swing- given their music was to blame for all these murders. At least that was their logic in the late 1980’s.

    BROOKS POSTON: He came up with eight people. And uh, they were all sporting knives then. And saying how bad it was getting in the city. And that Helter Skelter – that’s what he calls the negro revolt. He says the negros are going revolt and kill all the white men, except the ones that are hiding in the desert.

    He does get into all the detail and to a point that if anyone invented Helter Skelter, it would have been Brooks and not Bugliosi.

    Now maybe they killed two birds with one stone...

  14. Oops. You're right on Brooks. But he does place the comments "about a month ago" which would make it after the murders. I think Helter Skelter as a theory evolved from general anti-establishment to racial Armageddon beginning some time in February or March of 1969, but it's unclear whether Manson really talked as widely about Helter Skelter in a racial context as the prosecution made out. HS seems more like a general framework that Manson then would hang whatever his grievance of the moment was and his grievance at that time was the Panthers because he believed he had killed one of them.

    But I still dont believe thay was Manson's motive for TLB. He may have used it to con the others. He may have even believed it a little himself. But I think his motives were much more basic.

    I have to disagree. Beginning in about December '68 Manson talked to near strangers about HS and anyone else that would listen. HS was always about a race conflict it wasn't always called 'Helter Skelter'. Manson was a borrower not a creator. He probably came up with the concept in about 1964 and heard it from the 'black muslims' he suddenly was surrounded by in prison. It was almost as if they didn't exist one day and very vocal the next. It seems to me that 'God's chosen people will come at the white devils in the dark with knives' is not that far a stretch conceptually from 'creepy-crawl' murder.

    Was HS the motive? I don't think it was Manson's motive, either.

  17. There are a lot of things in the backs of minds. But I thought that the element of race didn't enter into Manson's comments to the Family until February of 1969 when he told Brooks at the Gresham Street House that blacks would go to rich parts of the city and commit horrible murders and write "pigs" on wall in blood.

    Didn't Juan Flynn testify, or intend to testify, about Manson going to upper class neighborhoods and stopping in front of houses and going in and killing people irrespective of any racial motive? Was this before or after?

    The distinction I am trying to make is that violence against the establishment seemed to be a view of Manson's that predated Helter Skelter. The race-war theme seems to be laid on top of this beginning in 1969, regardless of how long it was floating around in his consciousness. And although there are dozens of documented instances of Manson talking about violence and contempt against the establishment, are there really that many instances of him talking about the race war?

  18. Isn't it impossible to prove a negative? Trying to prove what was not the motive is even harder than proving what was the motive.

    That said, if the LAPD had made public that Healter Skelter was written in blood on the LaBianca's refrigerator, the cops would have been tipped and the Spahn Ranch crew probably all would have been in custody by August 12th.

    Oh, and Shorty Shea would still be alive.

    "...even in the beginning(1967?), he was indoctrinating us to believe that black people were going to rise up collectively against white people. While he wasn't necessarily framing it as an armed conflict initially, he talked to us in the Family about the blacks and whites and the coming insurrection. As he told it, he had been in jail with black people, and this was something he had heard from them."

  21. It's difficult to try to gauge how much Manson really believed the race war stuff and much of it was a manipulation tool. I just can't help but be struck by how stupid and senseless all of it is, these people were killed by a pack of morons.

    Obviously a StarRider is much better looking than cheap imitations. Seriously, this username is one I've had since the late 90's, across many discussion groups, etc., it has nothing to do with the subject of this blog.

  22. We will never know the truth about Manson's real motive for these murders. As far as I know, he didn't leave behind any documents or messages contrary to HS. His groupies carried out his murderous crimes and if they believed HS to be justification for their actions, then that is their true motive.

    IMHO, Manson believed people of African decent to be inferior intellectually; he felt they, collectively, could be a powerful force. As a prison inmate, this was his experience. Despite where he ended up, geographically, he grew up in the Midwest and spent enough time in rural white America to begin his disdain for blacks. His years in prison just heaped more hatred and fear into his ideology.

    Was HS Manson's true motive for the family's murderous campaign? Maybe, but it wasn't the entire motive. Here was a man who hated authority (outside of himself). He craved stardom and attention. He had a "Christ" complex. He was resentful towards anyone who stood in his way, stood up to him or had more clout than him. Perhaps he was insane. Outside of the fame and fortune, he had everything he said he wanted: women, drugs, sex, a roof over his head and food in his belly, thanks to the Family.

    Krishna Venta is most likely the one that Manson borrowed the race war concept from. Manson put his own spin on it, but the template was Venta's :

  35. That the Family talked about HS, or any apocalyptic scenario, is not debatable. They did. The only question is whether it was a viable motive in the murders in any way, and to me it's murky. I've always thought if even one knife wound was inflicted with HS in mind, then the lunacy of HS plays a legitimate part in the case ... like it or not. And we know Leslie, for one, was a HS buyer. Vince's ethical impurity here is that he took a contributing factor and made a complete meal of it to sensationalize the case, and by extension his book. That criticism is fair.

  36. Well - One has to wonder how has to wonder how history would have been altered if the Beatles had never released S/T (The White Album) in 1968. There is no denying the madness and anger and paranoia was in full swing at Spahn and, that Charlie had been "preaching" his own "scripture" since he had been released frim the joint in '67. Still...the HS motive, and, the inclusion if the most famous musical act since Elvis into the case, had to at least impact the massive, spiralling hysteria/wonder/amazement/shock of the details/backstories of case/perps/victims involved
